Notice pursuant to EU Regulation 2016/679 ("GDPR")


This Privacy Policy explains how the personal data ("Data") you provide to EUROCOLTELLERIE S.r.l. ("us", "to us/us", "our" or the "Company"), which collects it, will be treated in accordance with applicable laws and regulations. The Company is committed to protecting and respecting your privacy.

1. METHODS OF OBTAINING DATA 


The data that may be collected, processed and stored are:

  • Data provided by you in order to receive a specific service or as part of a business relationship (such as contact information, professional data).
  • Data inherent to site navigation or data resulting from your interaction with our Web site.
  • Cookies (see the Cookie Policy section, on our website, which explains the use of cookies and other site access statistics analysis devices used by our website) Normallyyou provide us with your Data, but in some cases it is possible that third parties or public archives may provide us with your Data. The Company protects Data obtained from third parties in accordance with the policies described in this Privacy Policy.

2. METHODS OF DATA USED

The Company may process the Data collected for the following purposes:

  • I. to fulfill your requests by providing information about our products, services, offers and sales network;
  • II. to pursue our interest in establishing, maintaining and improving our relationship with you;
  • III. in case of your explicit consent, to send commercial communications and newsletters, as well as advertising information related to our products and services or aimed at performing market research. All these activities may be carried out in paper form or through automated or electronic means including mail, e-mail and telephone (e.g. automated phone calls, SMS, MMS, fax) and any other means (e.g. websites, cell phone or tablet apps) - "Marketing";
  • IV. in case of your explicit consent, disclose Data to the Company's subsidiaries and affiliates as well as to its authorized dealers and distribution network; these partners will process your Data for the purpose of sending commercial communications and advertising related to their products and services or aimed at performing market research - "Third Party Marketing";


    Collection and processing of your Data will take place on the basis of contract and our explicit and legitimate interest in processing as set out in (i), (ii), while subject to your explicit consent for marketing purposes as detailed in (iii) and (iv). If you have given your consent, you may revoke it at any time. Your Data may be processed electronically within IT systems and manually in paper form. Your Data will be processed and stored for its full life cycle and its security and confidentiality will be ensured based on principles of honesty, legality and transparency and in accordance with applicable laws and regulations.

3. CONSEQUENCES OF NOT PROVIDING DATA


It is never mandatory to provide your Data. However, failure to provide Data that is necessary to provide services or products and is marked as mandatory may prevent us from providing the requested service or product or may affect the quality of the provision of the requested service or product. Conversely, failure to provide Data marked as optional will not prevent you from accessing the service or receiving the product.

4. HOW YOUR DATA IS SHARED


Your Data may be shared with and disclosed to our subsidiaries and affiliates, trusted external parties, service providers, authorized distributors and dealers, and business partners, located inside and outside the European Union, who are subject to specific contractual obligations and may use the Data solely to achieve the purposes listed above. Your Data may be disclosed to third parties in order to comply with legal obligations, manage and maintain our security, protect our property rights, and obey orders from public authorities or exercise our rights before judicial authorities.

5. METHODS


For the purposes of your Data processing activities described above, we may transfer Data to countries outside the European Economic Area (EEA); this includes storing your Data in digital or physical databases maintained by entities acting on our behalf. Database management and Data processing are limited to the purposes of the processing and are carried out in accordance with applicable data protection laws and regulations. If Data is transferred outside the EEA, the Company implements all appropriate contractual measures to ensure the adequate protection of your Data, including, among other things, agreements based on the Standard Data Protection Clauses adopted by the EU Commission applicable to the transfer of personal data outside the EEA.

 6. RETENTION OF USERS PERSONAL DATA


The Company retains Data in its systems and archives for as long as necessary to fulfill the purposes described in this Privacy Policy, taking into account any legal and contractual requirements. Once the purposes for processing your Data have been exhausted, your Data is deleted or retained in a form that prevents the identification of data subjects, provided that the retention of such Data is not legally required or permitted for us. Data may be retained for a longer period to the extent necessary to protect our interests in connection with potential liability related to the provision of services or products or the processing of your Data. Data processed for Marketing purposes will be retained until you revoke your consent and, in any case, in accordance with the above principles and the guidelines provided in this regard by the relevant Privacy Guarantors.

EUROCOLTELLERIE S.r.l., headquartered in Novate Milanese - Via Vialba 52, is the Data Controller for the Data it collects, processes and stores under this Privacy Policy.

8. RIGHTS OF USERS WITH RESPECT TO THEIR DATA


You may exercise your rights as set forth in applicable laws and regulations, including:

  • Right of access: the right to obtain from the Data Controller confirmation as to whether or not your personal data is being processed and, if so, to obtain access to your personal data
  • Right to rectification: the right to obtain from the Data Controller the rectification of inaccurate personal data concerning you and to obtain the integration of incomplete personal data, including by providing a supplementary declaration
  • Right to erasure: the right to obtain from the Company the erasure of your personal data without undue delay, if the request is made in accordance with applicable laws and regulations
  • Right to object to the processing of personal data: the right to object at any time to the processing of personal data concerning you, subject to the legitimate interest of the Data Controller
  • Right to restriction of processing of personal data: the right to obtain from the Data Controller the restriction of processing activities if the accuracy of personal data is contested, for the period necessary for the Data Controller to verify the accuracy of such personal data
  • Right to portability of personal data: the right to receive in a structured, commonly used and machine-readable format, personal data concerning you provided to the Data Controller; also the right to transmit your data to another Data Controller without hindrance from the Data Controller to whom the data were provided, especially where the processing is based on consent or a contract and the processing is carried out by automated means
  • Right to lodge a complaint: without prejudice to any other administrative or judicial remedy, if you consider that the processing with regard to you has been unlawfully carried out or violates applicable laws and regulations, you have the right to lodge a complaint with the Supervisory Authority of the Member State where you habitually reside or work or of the State where the alleged infringement occurred

This information, along with other Data we already have, will be processed to fulfill your request as required by applicable law. If necessary, certain of your information may be transferred to other internal or external companies acting as Data Processors in order to fulfill your request. Processing of your personal information will occur during the time necessary to evaluate and handle your request; thereafter, your information will be stored for an appropriate period of time to enable the company to demonstrate that the request was handled correctly and appropriately.
